According to Presidential Decree 7/2018 and according to Directive EE 2015/2302

Please read carefully the following General Conditions of Participation, which are an integral part of the organized travel contract. Participation in any organized trip of our tourist office presupposes on the one hand the careful study of the trip program and on the other the unreserved acceptance by the traveler of the General Conditions of Participation. The General Conditions of Participation refer to general information, as well as the rights and obligations of the two contracting parties in the organized trip, while with regard to specific information (destinations, prices, days and times of departure and return, means of transport, accommodation, visits, etc.), which pertain to each organized trip separately, you must consult the current program.

THE ORGANIZER (TOURIST OFFICE)

We are a Tourist Office under the name "C.L. Konstantinos Tsanas Ltd." , with distinctive title "CDL TOUR LTD" based at 19 Agios Vassiliou Street, in Nea Ionia, Attica, with special registration number ΕOT 0259Ε60000740801, (hereinafter "tourist office"), which organizes trips, (either alone or in joint cooperation with other travel agencies), and we sell or make them available for sale ourselves or through another travel agency (seller).

2. GENERALLY

Information and details of travel programs may change due to extraordinary changes in conditions. In this case, you will be notified immediately in the most convenient way and therefore we must have all your contact information, for the declaration of which you are solely responsible. Any special wishes, needs or requirements of yours, regarding your trip, should be expressly included in the contract, as long as they have been agreed upon and are feasible.

3. REGISTRATION – PARTICIPATION IN ORGANIZED TRIPS

Registration is done by visiting our office or the offices of our partners, by e-mail, (fax, telephone and through our website on the internet, with the condition (in order to reserve seats on the specific trip): 1st of the payment of the prescribed each time in advance or the full amount, in cash, by credit/debit or prepaid card or by remittance to the tourist office, within 48 hours, and 2nd the unconditional acceptance and compliance with these General Conditions. For the valid registration, it must be stated on the advance payment receipt the specific trip, with the dates of departure and return and any other distinguishing information. defined otherwise in the relevant Contract. Any non-payment of the entire value of the trip in the aforementioned next year, entitles our travel agency to cancel the reservation and, if applicable, to charge cancellation fees, in accordance with the cancellation conditions provided herein.

The contracting party, who represents his family or group, has the obligation to inform all fellow travelers represented by him about the details and conditions of the trip. Participants through a third party have the same obligations as the representative who signed them up for the trip, and the tourist office makes available to them any relevant information, whenever requested.

The tourist services that will be provided to you, as well as the costs, are detailed in the Package Travel Agreement that you will have to sign. In the event that your physical presence is not possible (booking by phone, e-mail, etc.) you will receive the contract by e-mail (in this case you have the right to withdraw from the contract within 14 days from the date sent to your email, taking into account the associated cancellation fees as set out below).

In organized air tours, your escort will be at the airport of arrival and the services start and end with the arrival and departure from/to the destination airport of the tour respectively, while in road tours the group follows from the start of the journey. The tourist office reserves the right to replace the leader/companion during the excursion/trip if deemed necessary.

Our tourist office bears no responsibility for the days and hours of operation of markets, museums and archaeological sites or for sudden changes in hours (e.g., work stoppages).

4. PRICES – CHARGES ETC.

The price of the trips is indicated in the program and is calculated on the day the program is published, based on the cost of the services of each trip, the cost of fuel or other energy sources, the applicable fares / surcharges, any kind of taxes or fees, the exchange rate of foreign currencies in relation to the € (Euro), as well as any other cost factor (e.g., minimum number of participants, etc.). The tourist office, after exhausting all possibilities of prediction, reserves the right to readjust the prices, when the above cost factors change. In particular, the price of the trip can be changed up to 20 days before the start of the travel services. The specific price increase will be communicated to the traveler calculated in detail in a clear, comprehensible and distinct manner.

In the event of a price increase of more than 8% of the value of the trip, the traveler may terminate the contract without paying a termination fee and be refunded the exact amount paid. If the traveler terminates the package travel contract for the above reason, then the traveler may accept another package of equivalent or higher quality. The traveler's obligation is to notify our tourist office, in writing, of any decision within a reasonable period of time, but in no case can it exceed 3 days from the moment the price increase is communicated to him. In the event that the traveler does not respond in writing within the above deadline, the tourist office is obliged to cancel his participation and return to him all the money he has paid without any other obligation, taking into account the related cancellation fees mentioned below.

The tourist office has the right, for a certain period of time or for a limited number of seats, to sell participation seats at more favorable prices (early booking-last minute offers).

Child rates vary depending on the case: from offering free accommodation, without meals, in hotels and ships, to a small discount (for ages 2-12 and only when two paying adults share the same room or cabin).

Prices do not include accommodation taxes and municipal taxes. In Greece the accommodation tax per room/suite and per night is: Hotel 3*: €1.50, 4*: €3.00, 5*: €4.00 and based on the relevant law is paid by the customer* from directly to the respective hotel. * (Unless otherwise stated in the travel contract)

5. THE OBLIGATIONS – THE RESPONSIBILITIES OF THE TOURIST OFFICE

Our tourist office has the obligation to coordinate and execute in the best possible way the trips available to travelers. However, having exhausted every possibility of prediction and care, it is not responsible for wrong actions and omissions of third parties and their partners, as well as for extraordinary situations, such as cancellations, delays or changes of routes of the various means of transport (planes, ships, buses, trains, etc..) or in the case of blocking areas due to terrorist acts, strikes and other causes of force majeure. The tourist office cannot predict or control any delays of chartered flights (charters) or scheduled planes or ships for technical or meteorological or other reasons so travelers should not plan important personal activities or combine other movements, on departure/arrival days).

The travel agency is not able to predict or control circumstances that are outside of its sphere of influence and may lead to the cancellation of the trip or damages due to non-performance or defective performance of the agreed travel services. Examples of such cases are: strikes, accidents, diseases, epidemics, organic disorders due to local conditions, altitude, climate, due to meals not included in the travel program or due to insufficient sanitary conditions due to external factors, injuries or hardships due to war, coups, terrorist acts, hijackings, earthquakes, weather conditions, fires, epidemics, toxic contamination and any other emergency or force majeure situation. In the above cases, the tourist office bears no responsibility for the restoration of any damage caused by them, but will make every effort to support and take care of the travelers in any way, without establishing for it any responsibility or obligation to cover the relevant extraordinary expenses, which should be covered, as in cases of force majeure, by the travelers themselves.

Complaints during the trip must be reported immediately and on the spot to the attendant and the provider of the specific service, in writing. If the problem raised cannot be resolved on the spot, after your return from the trip you must submit any relevant complaint in writing to our office within 7 working days, together with any documents or other evidence you have of the its justification. After 7 days have passed, the tourist office has no obligation to respond to any claim. If damages occur due to the non-execution or faulty execution of the services of the organized trip, the compensation to the customer is limited to what is defined by the international agreements that bind the country and govern the services in question. The compensation based on the non-execution or defective execution of the services of the organized trip is limited to twice the value of the per person price of the trip.

For an organized trip to be possible, a minimum number of 20 (twenty) participants is required. For longer trips, the minimum number of participants is limited to 15 (fifteen) people or the number determined by the excursion program. If this number is not filled, our office reserves the right to cancel the specific trip, but must inform the customers who had registered for it and return the money they had paid, without any other obligation.

The tourist office offers only the services mentioned in the descriptions of the organized travel programs. Any optional features are available at an additional charge, if possible. Our tourist office bears absolutely no responsibility for optional services.

After the end of your trip, the tourist office is required to issue the statutory tax documents, which will be received by our office, on working days and hours (from Monday to Friday 10:00-14:00) or will be mailed to you.

6. THE OBLIGATIONS – THE RESPONSIBILITIES OF TRAVELERS

Because other people usually take part in the organized trip, it is necessary for the corresponding social behavior and absolute compliance of the travelers with the travel program and the instructions of the escorts or guides and their timely arrival at the meeting places for the various benefits of the program (flights, transport, guided tours, excursions, meals, etc.). If the traveler's delay or inconsistency results in the loss of a flight, excursion, transfer or any other service offered, the traveler must rejoin the group at his own risk and expense, with no right to a refund for the missed service or and for the entire journey, if it fails to reconnect. The tourist office will make every effort to assist him, without having or assuming any obligation and responsibility.

You should be at the airports and ports at least two (2) hours before your departure. If there is no accompanying person on the trip, you must confirm on the spot your next flights with the airline and make sure what time and from which airport and station (terminal) your flight departs.

In the event that a traveler interrupts his trip by his own decision and leaves the group, he is not entitled to any further service or compensation, and the responsibility and costs of any travel outside the group shall be borne solely by him. In the same way, our office bears no responsibility for organized travel services that were not provided to the traveler due to his own negligence or responsibility, due to his illness or sudden accident. In the event that the customer is prevented from participating in the organized trip in which he has reserved a place, he can assign (by informing our office in writing) his reservation to another person, who meets the conditions for participation in the specific trip, no later than 7 days before from the start of travel services, while for sea transport the corresponding deadline is 10 working days before departure. The substitute and the original participant are jointly and severally liable towards the tourist office, to pay to it any outstanding balance of the amount, as well as any additional costs of this assignment. It is clarified that any possible change should be exactly within the same framework and will be acceptable as long as all the service providers in the organized trip (commercial companies, hotels, etc.) accept the changes. Travelers are responsible for the actions of accompanying children and must supervise them continuously throughout the trip for their safety and behavior.

Especially in the case of air carriers, it should be pointed out that it is not allowed to change the passenger's personal information, but only to cancel the existing reservation and reserve a new seat, as long as this is possible and at the corresponding cost. The tourist office bears no responsibility in the event that this is not possible, and the resulting mandatory cancellation of the reservation will be made in accordance with the cancellation conditions provided herein or by the service suppliers. In the case of air tickets that have been issued for return or multiple routes, it is not always possible to use individual legs of the ticket. The user should contact the tourist office directly to find out about the policy applied by each airline.

If the trip is interrupted, due to quarantine or possible hospitalization of the participant or for any further preventive reason of public health of either the destination country or any intermediate country, CDL TOUR LTD bears absolutely no responsibility towards the traveler for not providing part or all of the agreed services, not having any obligation for any kind of compensation or replacement of non-provided service at a later time.

7. HOTELS-ACCOMMODATIONS/ SHIPS AND OTHER MEANS OF TRANSPORT

All information regarding the categorization or classification of the hotels and accommodations mentioned in our travel programs is in accordance with the applicable legislation of each state on the tourist classification of hotels and accommodations, which may however differ from country to country in a country. Most hotel rooms accommodate two beds or a double. Triple rooms are mostly doubles with an extra bed. It is possible that this bed may be narrower than the normal or sofa/bed. The rooms are usually delivered by the hotel between 14:00-16:00 and are available to the occupants until 10:00-12:00 on the day of departure (depending on the policy of each Hotel). In case you wish to enter the room earlier or leave later, you will have to pay the relevant charge (subject to availability). If, due to unforeseen difficulties, the organizer of the trip is forced to change to another hotel of the same or higher category, the tourist office is not obliged to compensate the travelers.

In case of late arrival at the hotel, after the day or time of the traveler's scheduled arrival, and if he has not informed the hotel in time, the latter has the right to cancel the reservation and make the room available for the entire period of the reservation, if asked for.

In the case of overbooking, the travel agency will try to replace the room with another hotel room of the same category or if this is not possible with a hotel room of a lower category and will refund the customer the resulting difference, without our travel agency incurring any further liability or obligation.

On coach trips on Greece tours, seats are given in order of registration and do not change during the journey, while on foreign tours they change daily. Smoking in the coach is prohibited.

Airlines, for their own reasons, sometimes charter another airline's planes for their own flights. This case is not a reason for the customer to cancel the trip or claim any compensation.

We recommend that you do not leave exposed and constantly monitor all your personal items in any place. Hotels in particular do not take responsibility for money or valuables left in the room. For such cases there are often small safes in the rooms or at the reception.

8. PASSPORTS, ENTRY VISAS & HEALTH FORMS

The passport should be valid for as long after the planned return date as determined by the destination countries. The countries of the Schengen zone also accept the new type, with Latin characters, police IDs. Official IDs (police, military, etc.) do not count as travel documents.

Our tourist office provides the necessary information regarding travel documents and other documents required for Greek citizens, but is not responsible for any non-issue or non-visa of these by the competent authorities, to whom the traveler must contact. It is also not responsible if the validity of the visa is shorter than the duration of the trip or if a couple of travelers have different citizenships, outside of Schengen. Nationals of other countries, holders of foreign passports, must inform the tourist office and check whether they need an entry visa or any other documents for the countries they will pass through or travel to, as well as for their re-entry into Greece or the country from ' where they started. Any failure to secure the timely issuance or visa of your travel documents does not justify the cancellation of your participation in the trip without charging cancellation fees. Each traveler is responsible for the validity and validity, securing and safekeeping of their travel documents and tickets required for their trip and throughout the trip (We recommend that you always keep photocopies of your documents). The parent who accompanies a minor child alone must bring with him a certified authorization in English from the other parent, who is not traveling. In any case, our office does not bear any responsibility if the local authorities do not accept their entry into their country or the airline does not allow them to enter the flight.

The traveler is obliged to comply with the national provisions and regulations as well as the instructions of the national authorities. The tourist office bears no responsibility in the event that the traveler faces criminal prosecution, is summoned to appear before an authority, arrested by the local authorities, etc.

Customers with health problems should obtain their doctor's approval to travel by providing a medical certificate or a declaration that they are safe to travel. The tourist office bears absolutely no responsibility for illness, injury, loss of life, accident or other health emergency during the trip. In the event of a similar incident, the tourist office will try to support the victim, but is under no obligation to cover any absolutely related exit and change of the travel program, which will continue as normal.

9. THE INSURANCE

The tourist office has concluded a Civil Professional Liability insurance policy with the ALLIANZ Insurance company for every trip it organizes. The number of the insurance policy and the details of the insurance company are indicated in the package travel contract. The insurance policy deals with the event of insolvency of the organizer, covering all travelers.

It also covers bodily injury and material damage that will occur during the organized trip, any losses, repatriation of travelers with the same means of transport they originally traveled in case of bankruptcy and other coverages, for people who have not exceeded the age of 75 of age. For people over 75 there is a specific framework of travel insurance coverage. Also, to deal with illness during a trip within the European Union, we recommend that travelers contact their insurance provider for the issuance of the "European Sickness Insurance Card", which is optional. The tourist office also recommends travelers an optional insurance.

10. BAGGAGE

Baggage is carried at the responsibility and care of its owners. In case of damage or loss, the corresponding international conditions apply for each means of transport and for hotels, and the responsibility in this case is limited to what is provided by these conditions. The tourist office is also not responsible for the contents of the luggage.

On air travel, only 1 piece of luggage is allowed per passenger, with a maximum weight usually of 20 kg. In the event that additional costs arise due to baggage weighing more than the permitted weight, these are borne solely by the traveler and are paid on the spot at the airport. It is also noted that airlines allow only one hand luggage of small dimensions (about 50x40x25) in the passenger cabin. The traveler is obliged to comply with the instructions, regulations and general policy of the airline in the matter of overweight luggage for which the respective airline is solely responsible and in case of damage or loss, the IATA regulation and the tourist office bears no responsibility.

11. CANCELLATIONS

Cancellations of participation by the traveler are made only in writing to our office and, regardless of the date of the reservation (and if it is not possible to assign his reservation to another person under the conditions stated in the General conditions of participation), are subject to cancellation fees per person, depending on the time at which the cancellation is made, regardless of whether the corresponding amounts have already been paid by the travelers or not:For trips in Greece and abroad (and if there is no different cancellation policy):

 

Up to 45 days before departure: €50 for trips in Greece and €150 for trips abroad, per person, for administration costs.

From 44 to 30 days before departure: 40% of the total value of the trip.

From 29 to 14 days before departure: 75% of the total value of the trip.

From 13 days before departure until departure (non-show): 100% of the total value of the trip.

Different cancellation conditions apply to cruises according to the terms of each company's contracts.

Different cancellation policies apply to individual / individual trips.

In cases of fares with non-refundable prices, the cancellation fees even reach 100%, as determined each time by the airline or shipping company and mentioned in the excursion program or the offer of the respective company.

The above also applies in the event that the customer does not participate in all the events of the program, such as when e.g., he uses his own means of transport.

For departures that take place during festive periods, exhibition periods of sporting or artistic events, cruises or journeys carried out on specially chartered flights or ships, the above-mentioned cancellation periods may be longer and hold-up rates higher due to special circumstances.

Charges are made regardless of the time of registration or whether the corresponding amounts have already been paid by the travelers or not. In the event that one of the two people who have chosen to stay or are staying in a double room cancels their participation, they will pay the corresponding cancellation fees. As long as the above cancellation fees do not equal 100% of the total value of the trip, the person who will eventually travel, will also pay the difference of his room, as he will necessarily stay in a single room.

In case of cancellation of the trip by the tourist office and if the time of making the reservation allows it, the following deadlines for informing the traveler are followed:

20 days before the departure date, when the trip lasts more than 6 days,

7 days before the departure date, when the trip lasts between two and six days,

48 hours before the departure date when the trip is less than two days.

12. DISPUTE SETTLEMENT

We make sure that we are in line with the applicable legislation, at national and European level, regarding the correct use of personal data. For the provision of travel services, the traveler consents to the processing of his personal data, such as identifying information and information regarding the services he uses.

The tourist office and the traveler undertake to resolve in good faith any dispute that may arise during the execution of the contract of the organized trip. If the amicable resolution of the dispute is not possible, then the Courts of Athens are competent.
